The Australian government has tightened the student visa rules for foreign students to curb the influx of migrants. According to official data, migration to Australia has reached an all-time high, putting pressure on the country’s student housing market. The Australian government has made it clear that it wants foreign students to study in Australia, not just work there. Australia tightened its student visa rules on March 23 to reduce the number of migrants entering the country. The new rules include a ‘No Further Stay’ clause and restrictions on work opportunities for foreign students, which stand out as major changes that will have an impact on immigrant students’ future in Australia. 

What is a 'No Further Stay' Policy?

The condition of ‘No Further Stay’, or ‘NFS’ as it is commonly called, means that visa holders cannot apply for any visa in Australia, including work visas and permanent residency until they have first left the country after the expiry of their student visa," explains Harshita Agarwal Sharma, Director of Lexlevel Services. In the case of foreign students, the “no further stay” condition means that they can’t apply for any other visa (with a few exceptions) while they’re in Australia. This applies whether or not the student’s current visa has expired or is still valid. The purpose of the ‘no further stay’ clause is to prevent foreign students from taking advantage of temporary visas as a way to extend their stay indefinitely by applying for various types of visas while they are already in Australia. The purpose of this clause is to ensure that foreign students follow the terms of their original visa and discourage visa overstayers. Sharma further elaborates, "Initially applied to short-term visas like tourist visas to prevent extensions of stay through different visa categories, its application to student visas adds a new layer of complexity for international students and workers."

Implications of the 'No Further Stay' Policy

This restriction can have a big impact on foreign students. For instance, if a foreign student wants to stay in Australia for an extended period of time after the expiry of his/her student visa, he/she would have to return to their home country to apply for a new visa. This restriction limits the options for foreign students who want to stay in Australia to study, work or for any other purpose after the expiry date of the student visa. This highlights the need for proper preparation and understanding of the visa conditions prior to entering Australia so that there are no consequences in the future.

Effect on Job Opportunities

The 'No Further Stay' condition in Australia's visa policy can significantly impact employment opportunities for visa holders. 

  • With this restriction, individuals may find it challenging to explore job prospects post-graduation or during their stay.

Sharma explains, "Previously, students could move to other visa categories, like skilled work visas or post-study work visas, allowing them to seek long-term career opportunities in Australia." He further stated, "This new restriction narrows the path to post-graduation employment, creating uncertainty and potentially disrupting career paths." Furthermore, with fewer work opportunities for immigrant students, international students will face financial strain, as they must now rely on the restricted work rights offered by student visas. This impacts not only the financial stability of immigrant students but also the wider economy. Industries that rely on international students' labour may struggle to staff and sustain operations. The key question to consider is whether Australia is ready for such a significant change in its workforce.

Impact on Indian Nationals

Australia's new student visa regulations have raised concerns among Indian nationals, especially among students and those applying for visa renewal. Shradha Gupta, Partner at Accord Juris, stated, “The restrictions will have a far-reaching effect on students’ ability to pay for their studies and livelihoods, even though the overall effect on Indian nationals living in Australia will be minimal.” She points out that the circumstances under which an Indian national can apply for a waiver under the ‘No Further Stay’ condition are very limited and offer little relief.
For Indian nationals, this policy means that if they have this condition attached to their visa, they cannot lodge a new visa application. At the same time, in Australia, unless there are compelling and compassionate reasons for a waiver, such as major changes beyond their control like death or serious illness of close family, natural disasters in their home country, or war or civil unrest in their home country. Indian visa holders in Australia must understand the implications of the 'No Further Stay' condition and the limited circumstances under which they can apply for another visa while in the country.
