H 203, Greenwoods, Chakala, Andheri Kurla Road, Andheri East, Mumbai- 400093 and its corporate office at Office No.31, 3rd Floor, 124 Viraj Premises, Above HDFC Bank, Khar West, Mumbai – 400 052.

8.3 Law and Order: We cooperate with law enforcement inquiries, as well as other third parties to enforce laws, such as: intellectual property rights, fraud and other rights. We can, and You so authorise Us, disclose Your Personal Information to law enforcement and other government officials as We, in Our sole discretion, believe necessary or appropriate, in connection with an investigation of fraud, intellectual property infringements, or other activity that is illegal or may expose Us/ Us or You to any legal liability.

To remove Your profile so that others cannot view it, contact our customer support at contact@amberstudent.com.

We shall retain in Our files information You have requested to remove for certain circumstances, such as to resolve disputes, troubleshoot problems and enforce Our terms and conditions. Further, such prior information is never completely removed from Our databases due to technical and legal constraints, including stored 'back up' systems. Therefore, You should not expect that all of Your personally identifiable information shall be completely removed from our databases in response to Your requests.

10.CONTROL OF YOUR PASSWORD: (OPTIONAL)

We employ many different security techniques to protect such data from unauthorised access by members inside and outside Amber Healthcare Solutions Pvt. Ltd. and other com panies and third parties. We follow generally accepted industry standards to protect the Personal Information submitted to Us and information that we have accessed. However, “perfect security” does not exist on the Internet. You therefore agree that any security breaches beyond the control of Our standard security procedures are at Your sole risk and discretion.

12.INDEMNITY:

You agree and undertake to indemnify us against in any suit or dispute by any Third Party arising out of disclosure of Personal Information by You to Third Parties either through Our Website & Application or otherwise and Your use and access of websites, applications and resources of Third Parties. We assume no liability for any actions of Third Parties with regard to Your Personal Information, which You may have disclosed to such Third Parties.

13. PAYMENT POLICY

Definitions:

  • Buyer: Person or business paying for a good or service via Amber.
  • Buyer Account: shall mean a bank account or credit/ prepaid/ cash card account of the Buyer with the Issuing Institution.
  • Seller: Person or business listing or selling a good or service supported through Amber.
  • Transaction: Online purchase of any Products or making of Payments for specified purpose by the Buyer on the Seller's store through Internet Payment Gateway.
  • Purchase: A Buyer paying for the good or service listed via Amber platform.
  • Card Network/Card Brand: Networks that power credit card transactions. These include Visa, MasterCard, American Express and Discover.
  • Nodal Account : means an account held by Amber with any of the banks for the purpose of pooling the monies collected from all the Sellers and facilitating the subsequent pay-outs to the Seller, pursuant to directions issued by Reserve Bank of India for opening and operation of accounts and settlement of payments for electronic payment transactions involving intermediaries vide its notification RBI/2009-10/231 DPSS.CO.PD.No.1102 / 02.14.08/ 2009-10 dated November 24, 2009 ("RBI Intermediary Guidelines").

* All cash payments received by the Vendor shall be transferred to Amber representatives / executives each week as per the agreed ratio in the Schedule hereto.

* On receipt of the Payments in the Nodal Account, we will endeavour to instruct the nodal bank to transmit the Payments payable to the Seller, after deducting our Fees, from the Nodal Account to the Seller's designated bank account, within 3 (three) Business Days (or such other period as may be prescribed by the RBI from time to time) from Completion of Transaction.

* Subject to any other Clause of this Agreement and Completion of Transaction, the Seller acknowledges that we will settle the Payments only upon actual receipt of Payments in the Nodal Account and upon reconciliation of the Payments by the Acquiring Banks, Amber and the nodal bank.

* The Seller will bear and be responsible and liable for the payment of all relevant taxes in relation to the Payments made under this Agreement.

* Sellers receive the amount (minus our charges) in their bank account within T+3 days where T is defined as the date of intimation of the completion of the transaction.

* Once a payment is authenticated by Payment Service Providers, money is moved to Amber Nodal Bank Account and the first settlement will be initiated only after all required documents (in hard copies) are received by Amber.

14.SEVERABILITY:

Each paragraph of this privacy policy shall be and remain separate from and independent of and severable from all and any other paragraphs herein except where otherwise expressly indicated or indicated by the context of the agreement. The decision or declaration that one or more of the paragraphs are null and void shall have no effect on the remaining paragraphs of this privacy policy.

15.AMENDMENT:

Our Privacy Policy may change from time to time. Hence we shall post any privacy policy changes on the homepage of the Application/Website or notify You on Your registered email with us.
