USCIS updated Policy on M and F Students

USCIS (U.S. Citizenship and Immigration Services) has recently updated its policy for the M and F nonimmigrant students. On 20 December 2023, USCIS focused on clarifying the existing policy for International students and U.S. educational institutions. 

The guidance for M and F students focuses on the agency’s adjudication processes for employment authorization, change of status, extension of stay, and reinstatement of status for students and their dependents in the United States. 

As per the recent US immigration news, students who want to be eligible for M and F classifications must follow certain conditions. One of the notable clarifications that USCIS stated is that the M and F students should maintain a foreign residence that they do not wish to abandon. Furthermore, the latest USCIS guidelines state that these students are eligible for beneficiaries of a permanent labor certification application or immigrant visa petition. 

Additionally, talking about the employment context, F-1 students looking for a two-year STEM optional practical training (OPT) extension can be employed by start-up companies. However, in this case, the start-up is expected to meet the regulatory requirements, which include a good training plan and E-verify.
