Replacement Tenant Accepted
<p>The Residential Tenancy Agreement, Rooming House Agreement or License to Occupy is a legally binding document, which if broken will incur penalties. Where a resident believes they cannot stay in the room or continue to pay the Rent/Occupancy Fee, they must notify the property in writing and complete a lease break form as soon as possible.</p> <p><br></p> <p><strong>A. When considering prematurely terminating your Residential Tenancy Agreement, Rooming House Agreement, it is your responsibility to do the following:</strong></p> <p><br></p> <p>1. Continue to pay the rental payments for the remainder of the agreement or until the apartment is re-let plus a portion of the letting fee and advertisement fee (if you have nominated the property to advertise for you, calculated according to the Residential Tenancies Tribunal formula).</p> <p>2. You may help in finding another suitable person, who needs to apply to the property and have his or her application accepted by them, to take over your apartment.</p> <p>3. A departure cleaning fee may apply if the apartment is not returned in the same or better condition to the owner.</p> <p><br></p> <p><strong>B. When considering prematurely terminating your License to Occupy, it is your responsibility to do the following:</strong></p> <p><br></p> <p>1. You will be charged an early termination fee of two (2) weeks’ occupancy fee if the License to Occupy is ended by you within the first 48 weeks of the commencement of the License to Occupy</p> <p>2. You will continue to pay all occupancy fees and charges as set out in Clause 3 of your License to Occupy until such time as an approved new Resident commences a contract for a period no less than the current agreement.</p> <p>3. Additional cleaning fees may apply if the room is not returned in the same condition, allowing for fair wear and tear.</p> <p><br></p> <p><strong>C. When considering prematurely terminating your Occupancy Agreement, it is your responsibility to do the following:</strong></p> <p><br></p> <p>1. You will be charged an early termination fee of two (2) weeks’ rent.</p> <p>2. You will be liable to pay the rent until the earlier of:</p> <p>— the end date of your Occupancy Agreement; or</p> <p>— the date that the property enters into a replacement Occupancy Agreement for the Bedroom,</p> <p>3. You will be liable to pay them the equivalent value of incentives that were accorded to you as part of your Occupancy Agreement.</p> <p>4. Additional cleaning fees may apply if the room is not returned in the same condition, allowing for fair wear and tear.</p> <p><br></p> <p><strong>Please Note: </strong>The Cancellation Policy is only available to new students with a booking, who have not previously stayed with the property.
