The property management does not offer any cooling off period, all contracts are legal and binding.
If the resident wishes to terminate the Residence Agreement before the end date the resident must notify the property in writing of their intention to terminate their Residence Agreement. The resident must give them no less than 28 days’ notice and continue to pay the Residence Fees until the earlier of:
1. The expiry of the Residence Agreement; or
2. The commencement date of a new Residence Agreement between a replacement resident and the property management.
Under extenuating circumstances they have the ability to reduce the notice period or fee associated with termination of a Residence Agreement. When considering terminating your Residential Agreement, it is your responsibility to do the following:
1. Continue to pay the residency fee as per the agreement until the apartment is re-let. They will refund any monies owed to you if and when the apartment is re-let.
2. Find another suitable person to take over your apartment so there is a continuation of payments.
3. In all cases the apartment must still be returned to the same standard that it was in at the commencement of the lease.
By accepting your offer, you have entered into a legally binding agreement, and you are responsible for the payment of the residence fees under this agreement for the agreed term.
Please note: In addition, a cancellation fee equivalent to 2 weeks rent must be paid.
A Residence Agreement may be terminated if:
1. The resident fails to pay rent by the due date and all notices to remedy have not been satisfied.
2. The resident’s behaviour is deemed “unacceptable” by the property (as defined by the Residence Agreement).
3. The resident resorts to or takes advantage of any law for the protection of insolvent people, becomes bankrupt or commits an act of bankruptcy.
Please note: At the termination of a Residence Agreement, all the residents’ personal belongings must be removed. Any belongings of value left in the apartment will be kept for 3 months and then disposed of.

Upon arrival, they must prepare a ‘Condition Report’, which records the property’s general condition, including fittings and fixtures, and present you with 2 paper copies of this Report when you come to collect your keys.
Review and, if necessary, add your comments to the ‘Condition Report’. You must return the report to the property management within three business days of moving in and you should keep a copy of the ‘Condition Report’ until the end of the tenancy.
The ‘Condition Report’ is a very important document, as it can be used as evidence if there is a dispute about who should pay for cleaning, damage, or replacement of missing items, particularly at the end of a tenancy.
You may want to take photos of your apartment at the start of your tenancy to further show the condition.
The owner may claim some or the entire bond for cleaning, damage, or replacement of missing items at the end of your tenancy. If the ‘Condition Report’ stated that the work was required at the start of the tenancy, or the items were not listed, it can help you prove the bond should be returned to you.
Your bond and rent are separate payments. You are required to pay rent in the specified way up to and including the date of your departure.
You need to leave your apartment clean and tidy in the same condition as when you arrived, ensure all personal items have been removed, and report any damage that may have been caused during your tenancy. This allows for a speedy bond resolution. Finally, you will need to complete a Web Departure Form on the StarRez Portal and nominate the bank account you would like your bond deposit refunded back into.
